Two Newport Police Department Officers were involved in the use of deadly force in response to an incident on December 9, 2015 located on North Highway 101 in the City of Newport. In any incident where an officer uses deadly physical force, the Lincoln County Deadly Physical Force Plan outlines specific procedures for local law enforcement agencies to follow in accordance with Senate Bill 111 of 2007 (ORS 181.640 and 181.662)
The use of deadly force by the Newport Police Department that occurred on Wednesday is being handled in accordance with this plan. This included removing those officers involved in the shooting from the scene as soon as other law enforcement personnel were available. Once adequate personnel from other agencies were present to control the crime scene, the remaining NPD personnel were dismissed from the site with this investigation then under control of the Oregon State Police as the lead investigative agency without any participation by the Newport Police Department. This includes NPD supervisors as well. Also, in accordance with this policy, the officers involved in the shooting have been placed on paid administrative leave. Under the policy an agency uninvolved with the incident conducts the investigation in order to have an independent review of this incident. In this case, the Oregon State Police is the agency charged with the investigation of this matter. The investigative team excludes the agencies involved with the use of deadly force. The Oregon State Police will provide their report to the Lincoln County District Attorney.
Upon conclusion of the review of this matter by the District Attorney, the City will be able to conduct an internal review of the matter for compliance with the Police Department’s own policies regarding this incident. Under the policy, any public information regarding the incident and subsequent investigation will be handled by the Oregon State Police and the Lincoln County District Attorney’s Office.
